Losing a loved one is one of life's most difficult experiences. When that loss also involves the need to sell real estate, the process can feel overwhelming. Probate — the legal process of settling a deceased person's estate — adds layers of complexity to an already emotional time. That's why having an experienced agent by your side matters.
WHAT IS PROBATE?
Probate is the court-supervised process of distributing a deceased person's assets. In California, when real estate is involved, the probate court must authorize the sale of the property. This process ensures that debts are paid and assets are distributed according to the will — or, if there is no will, according to California's intestate succession laws.
THE PROBATE TIMELINE IN CALIFORNIA
On average, the California probate process takes 12 to 18 months from start to finish. The timeline varies depending on the complexity of the estate, whether there are disputes among heirs, and the court's schedule. Here are the key steps:
Petition Filing
The executor or administrator files a petition with the probate court to open the estate and obtain authority to act.
Notice to Creditors
Creditors must be notified, and they have a set period (typically 4 months) to file claims against the estate.
Inventory & Appraisal
The court-appointed appraiser values the estate assets, including the real property.
Court Confirmation
In California, probate real estate sales typically require court confirmation, which involves a public hearing and an overbidding process.
Closing
After all debts are paid and the court approves distribution, the estate is closed and assets are distributed to heirs.
WHY AN EXPERIENCED AGENT MATTERS
Probate sales are not ordinary transactions. They involve court filings, specific legal requirements, strict timelines, and often emotionally charged family dynamics. An agent experienced in probate — one who understands the court process, can coordinate with attorneys and fiduciaries, and has the patience to navigate delays — can make the difference between a smooth process and a frustrating one.
With over 22 years of experience and over 200 homes sold, I've guided many families through probate sales across the Inland Empire and Greater Southern California. I coordinate with attorneys, handle the paperwork, manage the property, and keep you informed at every step.
"Clients often say my superpower is guiding families through difficult transitions with patience, compassion, and the expertise needed to navigate complex probate and trust sales successfully."
